The Directorate of Criminal Investigations has broken
the silence on the circulating land grabbing cases that have taken off.
Following a series of exhaustive investigations, has briefed Kenyans on the
following conclusions.
Munir Ahmed
Chaundri a 75 year old Kenyan citizen currently living in UK is the
registerd owner of land parcel No. 209/7771/2 located in Lavington.
On July 21, 1971, the complainant Munir Ahmed Chaundri
and his companion Malkiat Singh Assi (diseased) jointly purchased Land Parcel
No. 209/7771 IR No. 30800.
Munir Ahmed and Malkiat Singh jointly subdivided LR.
No. 209/7771/1 and LR. No. 209/7771/2 on July 25, 1988, after receiving consent
from the town clerk Nairobi City Council on entry no. 5 made on certificate of
title day book No. 1034. Later, they sold LR. number. 209/7771/1, which
measured 0.1569 ha, to TM-AM Construction Company under title number. 46272/1.
Complainant retained LR. NO. 209/7771/2 of 0.1563 hectares.
Munir stated that there was evidence that TM-AM was
interested in purchasing the remaining parcel LR No. 209/7771/2, but the
intention was later canceled by Lawyer Pramod Patel, who indicated that TM-AM
were no longer interested in the purchase in a letter ref. PJP/989/2 dated 11
March 1989.
The registered proprietors of LR. No. 209/7771/2 with
title no. IR 30800 and deed plan No. 128892 are Munir Ahmed Chaundri and Kamla
Assi (Malkiat widow). They have also paid the property tax.
Munir Ahmed Chaundri (complainant) submitted a sale
agreement dated 18 December 1987 between him and Baldev Singh Bhatti, a
director of TM-AM Construction Company.
Baldev Singh Bhatti is a director and shareholder of
the TM-AM Construction Company, which is an authorized company in Kenya under
the Companies Act 2015. Baldev Singh Bhatti's daughter-in-law Anita Bhatti is
the mother of Mahesh Kumar Bhatti. As a result, they become linked to the
mentioned land.
The suspect in this case has not given the detectives
any ownership records for the parcel of land that is the subject of the
investigation.
