    This is the process of registering an individual who will handle a property that was once owned by a deceased person on behalf of the beneficiaries of the property.

    To begin the registration process, open your preferred web browser and visit the website https://ardhisasa.lands.go.ke/

    1.      Enter your Ardhisasa ID or national ID number, along with your password. Click on Continue to proceed. You will receive a one-time password (OTP) on your registered phone number. Enter the OTP in the designated box and click Login. This will take you to the dashboard.

    2.      On the dashboard, you will find various services listed under different departments of the Ministry of Lands and Physical Planning. Since you are initiating this process as an advocate, switch to your Advocate account. Click on the profile icon, and from the dropdown menu, select your professional account that has been approved for you as an advocate.

    3.      Navigate to the land registration section. Look for the Transfer option and click on it. This will lead you to various transfer services. Among the transfer services listed, locate the option for Registration of Personal Representative as Executor or Administrator (form LRA 39) and click on it.

    4.      On the applications page, you will find different tabs, including Pending, Ongoing, Completed, Rejected, and Canceled. These tabs will list all the applications you have initiated as an advocate. To start a new application, click on the New Application button located at the top right-hand corner of the page. Before proceeding with the application, you will be presented with frequently asked questions (FAQs) specific to the registration of personal representatives as executors or administrators. Explore these FAQs to gain a better understanding of the application process, including the actors involved, requirements, payments, and necessary documents. Once you are satisfied, click on Next.

    5.      Enter the relevant personal details of the applicant. This includes the parcel number in the format registry/blog and the block number without any spaces, followed by the parcel number. Click on Next to proceed.

    6.      Enter the Ardhisasa ID of the transferor and click on Search. A pop-up box will appear, asking you to select the category of the person executing the transferor. You can choose between the transferor executing on their own behalf or an attorney executing on behalf of the transferor. If selecting the attorney option, enter the power of attorney entry number in the specified format and click on Search. If the attorney is not registered on Ardhisasa, enter their Ardhisasa ID as well. Click on Save.

    7.      Select the registration status of the deceased person. If the deceased was registered on Ardhisasa, select the first option and enter their Ardhisasa ID. Click on Search to retrieve the details. If the deceased was not registered, select the second option and enter their name and identification type, such as their ID number. Click on Next to proceed.

    8.      Enter the Ardhisasa ID of the transferee, who must be registered on Ardhisasa. Click on Search to retrieve the details. If you need to change the initial transferee, click on the Remove button and enter the correct Ardhisasa ID of the transferee.

    9.      Enter the date of the Grant of Will or the date for Grant of Letters of Administration. Depending on whether the deceased made a will or not, choose the appropriate date. You will also need to select the nature of interest being transferred, such as leasehold or freehold. Once you have confirmed the details, click on Next.

    10.   Add any information or provisions that the transfer is subject to, you can add them in this section. Provide the necessary details and click on Next to proceed.

    11.  Enter the details of the law firm under which you are acting. If the law firm is registered on Ardhisasa, enter the law firm’s ID and click on Search to retrieve the details automatically. If the law firm is not registered, manually enter the name, physical address, postal address, phone number, and email address of the law firm. Website and street address fields are optional. Click on Next to proceed.

    12.  Upload the necessary documents. The mandatory documents include the death certificate and the grant of probate. Click on the Choose File button to upload the scanned and certified copies of these documents in PDF, PNG, or JPEG format. If you have any additional supporting documents, you can upload them as well. Once you have uploaded the required documents, click on Next.

    13.  Review all the details you have provided throughout the application. Scroll through the page and ensure everything is accurate. If you are satisfied, click on Submit to submit the application. You will be prompted to confirm the submission, and upon confirmation, you will receive a pop-up message confirming the successful submission. Click on Close to complete the process.

    Once the transfer process has been initiated, both the advocate and the parties involved receive notifications via SMS and email. These notifications serve to communicate that the transfer process has been initiated successfully. The advocate and the involved parties are made aware that progress has been made towards the registration of the personal representative.

    Upon receiving the notification, the advocate is required to confirm the application and provide their signature to represent the party involved. The advocate clicks on the accept button in the execution section and is prompted to approve their representation of the party. By clicking on accept, the advocate accepts the responsibility and notifies the involved party that they will represent them throughout the transfer process.

    The involved party is then notified to verify the application and provide their consent for the advocate’s representation. Upon logging into their Ardhisasa account, the involved party navigates to the notification bell on the screen’s top right-hand corner. They will find a notification prompting them to verify the application. To authorize the advocate’s representation, the involved party clicks on the “Get OTP” button to receive a one-time password (OTP) on their registered phone number. The OTP is entered into the designated OTP prompt box for verification.

    Once the application is verified, the involved party is required to append their signature. Ardhisasa offers various options for signing.

    After the involved party has verified and provided their signature, the advocate logs into their Ardhisasa account to submit the application. The advocate navigates to the notification tab and opens the transfer application. The submit request button becomes active, allowing the advocate to proceed with the submission. By clicking on the submit request button, the advocate affirms their intention to submit the application. A confirmation notification appears, stating that the application has been submitted successfully.

    Conversion/Replacement of Title Issued from the Closed Register on Ardhisasa

    This process involves migrating land parcels from various land registration statutes to a unitary regime under the Land Registration Act of 2012. The aim is to cancel the titles issued under the repealed statutes and replace them with titles under the new regime.

    Once a parcel of land is eligible for conversion, the proprietor is given a 90-day period to raise any grievances. After this, the proprietor needs to initiate the surrender process by filling out the digitized Form LRA97. The current physical ownership document will be submitted along with the application. Once the conversion is successful, a ticket will be raised for the client to collect their converted title document.

    This process is initiated by an advocate one who is registered on the platform and has upgraded the account.

    1.      Log into the platform using your Ardhisasa ID or national ID number. Enter your password and click Continue. A one-time password (OTP) will be sent to the phone number registered on the platform. Enter the OTP in the designated field and click Login. You will then be directed to the dashboard.

    As an advocate, you need to switch to your advocate account to proceed with the conversion process. Click on the profile icon and select the professional account that has been approved for you.

    2.      Navigate to the land registration section on the platform. Click on View More to explore the services offered in this department.

    3.      Under the land registration department, you will find the applications page. You will see five tabs: pending, ongoing, completed, rejected, and cancelled. These tabs display the status of your applications.

    4.      To initiate a replacement of title application, click on the New Application tab. Before proceeding, it is recommended to review the Frequently Asked Questions (FAQs) provided on the page to familiarize yourself with the terminology used. Once ready, click Next to proceed.

    5.      In the Proprietorship Details section, enter the old and new parcel numbers in the specified format. The new parcel number can be confirmed from the gazette notice. Choose the appropriate ownership type (e.g., sole proprietorship) and provide the necessary details accordingly.

    6.      Select the appropriate option, either the proprietor executing on their own behalf or an attorney executing on behalf of the proprietor. If it is an attorney, select the attorney option and provide the power of attorney entry number in the specified format: registry/entry number/month of registration/year of registration. Click on the Search button to retrieve the attorney’s details.

    If there is more than one attorney acting on behalf of the proprietor, you can enter the power of attorney entry number for the second attorney in the same format and click on Search to retrieve their details as well.

    7.      Enter the Ardhisasa ID of the pickup person who will collect the new title document. Once the ID is entered, the name and ID of the pickup person will be listed.

    8.      Provide the details of the law firm you are acting for, including name, phone number, physical address, email address, and postal address. Additional details like website and street address are optional. If applicable, you can add the law firm by its Ardhisasa ID.

    9.      Upload a copy of the current title by clicking on the Choose File button. If there are additional supporting documents, you can upload them as well. Once satisfied with the documents uploaded, click Next to proceed.

    10.  Review all the details provided in the confirmation step. If satisfied, click Submit to proceed. You will be prompted to approve the submission, and upon confirmation, a pop-up message will confirm the successful creation of the application.

    11.  Navigate to the applications page on the platform. You will find your application listed among others. Locate your application and click on the View button to open it. Within your application, you will find the execution section. Accept or reject whether you represent all parties involved. If you are representing all parties, click on Accept. If you do not represent one or all of the parties involved, click on Reject. The parties involved will receive a notification indicating that you are not representing them and will have the option to select or add another advocate.

    12.  Append signatures as the advocate. There are several options for appending a signature.

    13.  Once you have appended your signature, click on the Save button to submit the application. Upon submission, the system will automatically create a ticket and an invite for you.

    Surrender the title, by providing your current title. Navigate to the My Appointments tab on the left panel of your screen. Locate the invite that has been created and click on View. You will be able to book an appointment on the calendar displayed on the right. Select the date and time you wish to surrender the title, and then click on the Submit button. A pop-up box will appear asking you to confirm the appointment. The invitation will transition to the Upcoming Appointments tab. Click on View to generate a gate pass, which you will present at the gate when surrendering the title.

    Once all parties have signed and the original title has been surrendered, the application will move to the registration department for processing and approval. You will be notified once the application has been approved. At this point, you can proceed to pick up your new title.

    How  Make the Application

    1.      Log in to https://ardhisasa.lands.go.ke/account/login using your user credentials, which include your address identification number or Ardhisasa ID and the password. You will receive a one-time password (OTP) code on the phone number registered with the platform. Enter the code in the OTP prompt box and click Log In.

    2.      Navigate to the Survey and Mapping Department. You will find various services offered, including new grants, subdivision, amalgamation, resurvey, sectional property survey, and sale of plans.

    3.      Click on the Applications tab to access the applications page. You will find two tabs: Pending and Completed. All the applications you have initiated will be listed in these tabs based on their status. To initiate a new application, click on the New Application tab located on the top right-hand corner of the page.

    4.      On the new application page, you will be prompted to select whether to use the person number or the FR number to search for the plan. Depending on your choice, enter the corresponding number in the provided field. Select the desired type of results: PDF plan, coordinate spreadsheet, or both. Click on the Search button, and the search results will be populated.

    5.      Review the search results and select the View option to see a preview of the plan’s location. If the plan matches your requirements, click on Add. After adding the plan, click on the Submit button to initiate the retrieval process from the digital repository.

    To view and download the plan, you must pay the sale of plans fee, which amounts to 200 Kenyan shillings. Navigate to the Invoice tab and click on Pay. A list of payment options will be displayed. Choose your preferred payment method and complete the transaction. Once the payment is made, click on the Confirm button located at the bottom left-hand corner.

    Application Steps

    ·         Getting County approvals. It is worth noting that the latter is not currently being done on a Ardhisasa.

    ·         Getting Land Administration approval or provisional approval for the development Control process.

    ·         Survey amalgamation and subdivision processes. This is where they get County recommendations and final approval.

    This particular application can be initiated by any member of the public the land owner.

    All processes that attract a payment will have a system generated invoice or invoices as well as the accepted payment channels to be used as such you should not make any additional payments to facilitate the processing of your application.

    Here is the process of Lease Preparation (Subdivision) application

    1.      Log in to https://ardhisasa.lands.go.ke/account/login with Ardhisasa ID or national ID number and password.

    2.      Navigate to the land Administration section and click view more and you’ll find the application listed under the services offered in this department. There are a number of tabs provided namely pending, ongoing, completed and rejected. All the applications that you have initiated will be listed among the tabs provided depending on the level of your application.

    3.      Click on the new application button on the top right-hand corner.

    4.      Explore the FAQs to acquire knowledge on certain details that might be of interest to you before initiating the application.

    5.      Enter the parcel number of the mother parcel. This is the original parcel number in the format REGISTRY/ BLOCL118/PARCEL NUMBER.

    Once the application reaches the Land Administration Department, it will go through various stages, including valuation, rent payments, and generating an invoice for new Grant fees.

    If the application involves subdivided parcels, add beneficiary details for each parcel. Also, invite your preferred advocate to represent you and the beneficiaries in the application process.

    The Advocate should switch to their Advocate account and accept representation. They will also sign the application electronically using the provided signing options.

    After beneficiaries have executed the application, you will receive a notification to submit the application to the registration department for processing.

    Once the application is completed, you or your Advocate will be informed about where and when to collect the registered list document and certificate of lease.

    3.      Switch to your license survey account by clicking on the profile icon and selecting the professional account approved for you as a licensed surveyor.

    5.      The applications page consists of four tabs: Pending, Ongoing, Approved, and Rejected. Your initiated sectional property survey applications will be listed based on their processing status.

    Upgraded accounts are to be annually renewed to capture the current version of your practicing certificate. To renew a professional account, you need to have upgraded your private account.

    Here is the process of renewing a professional account.

    1.      Log in to the https://ardhisasa.lands.go.ke/account/login using your user credentials (identification number or Ardhisasa ID) and account password.

    2.      Enter the one-time password (OTP) sent to your registered phone number or email to access your account.

    3.      On the left-hand menu bar, click on Account to access your account settings.

    4.      Within the account settings page, click on the Upgrade Account tab.

    5.      You will find a list of all past applications related to upgrading or renewing your account.

    6.      Applications are categorized by profession, date added, status, and the required action. The status Pending means your application is awaiting feedback from the ministry staff. Approved status indicates a successful application, and your account is now upgraded or renewed. Rejected status means the application was unsuccessful, often due to issues with registration, admission, or license numbers, or outdated documents.

    When the timeline for obtaining new practicing certificates has lapsed or professional accounts get deactivated and the user is notified of the same.

    7.      To renew your account, click on the View button next to the pending application.

    You’ll be directed to the details page, showing your request status and application details.

    8.      Click on the Renew button at the top right corner of the screen.

    9.      A pop-up box will prompt you to upload your current practicing certificate.

    10.  Upload the document and enter your registration, admission, or license number as stated in the certificate.

    11.  Click Close on the pop-up box to complete the application.

    12.  Refresh the account upgrade page to see your newly made application.

    13.  If the status is Pending, the application is awaiting action from the relevant department.

    14.  You will receive a notification on your account when a response is received.

    15.  To check the response, click on the notification bell or revisit the View button on the account upgrade page.

    16.  If approved, your new practicing certificate will be updated, and transactions for the current year can be processed.

    17.  If rejected, reasons for the rejection will be visible in the comment section.

    KRA recently requested Airbnb for details of its hosts in Kenya. Here is information related to the request from KRA.

    As you already know, there are quite a number of ways to make money with Airbnb. Once you make the money, the following information can help you get started in learning about some of the tax requirements that might apply to you when providing short-term accommodation in Kenya.

    Income from Airbnb is taxed via either:

    1. Monthly Residential Rental Income Tax, or
    2. Regular Income Tax
    3. Value Added Tax

    All income from your Airbnb in Kenya is taxable whether you are a resident person or non-resident person. So, even if you do not live in Kenya but have an Airbnb or furnished apartment that you let, you need to pay tax.

    Monthly Residential Rental Income Tax (”MRRIT”)

    Where Rental income from providing Airbnb or furnished apartments in Kenya is between KES 288,000 and KES 15 million per annum, it will be taxable at the rate of 10% on the gross rent received either monthly, quarterly or semi-annually.

    This regime is only applicable to Kenya residents and is a final tax. This means that no other taxes are payable. Further, Hosts who are accounting for MRRIT are not required to declare their rental income in their regular annual income tax returns.

    Please note that no expense is deductible under the MRRIT regime. So, any costs from cleaning, rent and other costs are not considered.

    This tax is filed on iTax, on or before the 20th  day of the following month. For example, rental income received in January is declared and tax paid on or before 20th  February.

    In addition to the above, if your income is above 5 million, you shall also need to charge VAT. See below section on VAT as well.

    For any month that you do not receive any rental income, you are required to file a NIL return. Failure to file tax returns attracts a penalty at the higher of KES 2,000 or 5% of the tax due while penalties for late filing for companies is the higher of KES 20,000 or 5% of the tax due.

    If you wish to be exempted from the MRRIT regime you would need to elect not to be subject to thereto by simple notice, in writing, to the Commissioner of Domestic Taxes (”the Commissioner”). In this case, the residential income earned will be subject to the regular Kenya income tax.

    Regular income tax in Kenya

    Business income for companies resident in Kenya is subject to income tax at the rate of 30% on the taxable income. However, businesses not resident in Kenya or that do not have a permanent establishment in Kenya, are taxed at the rate of 37.5%. The personal income tax rate in Kenya is at a graduated scale with the maximum rate at 35% of the gross income of a person.

    The adjusted taxable income comprises of gross income earned or derived from Kenya after deducting expenses wholly and exclusively incurred in the production of that income.

    Certain expenses may be deductible in computing income tax. The expenses that would be deductible against taxable income may include:

    •   general operational expenses like rent, service charges.
    • interest payable on any loans utilised for working capital requirements
    • salaries and wages

    Administrative costs and any other expenses incurred wholly and exclusively for purposes of running your furnished apartment. These include costs like rent, cleaning, buying consumables for your Airbnb and furnished apartment.

     Capital expenses would include costs for acquisition of the property (excluding repair and maintenance costs which are allowed for deduction). Therefore, cost of repair and maintaining the Airbnb can be reduced

    No deduction is allowed for depreciation either, however, wear and tear allowances are allowed for furniture and fittings at the rate of 10% per year on reducing balance.

    Where you are engaged in different types of business and earning income from both rental and business income, the expenses that are deductible against rental income are those that are directly and wholly incurred in the production of that rental income and cannot be offset against other types of income.

    Value Added Tax

    Provision of accommodation through serviced apartments, flats, holiday villas, beach cottages and villas, bandas, safari camps for short stays of less than a month are subject to VAT at 16%. Further, a serviced flat or apartment (although for rent longer than one month) which is not under a lease or license is also subject to VAT at 16%. However, provision of residential premises under a lease or license for period longer than a month is excluded from VAT.

    Should you make taxable supplies of at least KES 5 million within any period of 12 months, you are required to register and account for VAT. Note that failure to register for VAT where a person has met the VAT registration threshold is an offence under the VAT Act subject to a fine not exceeding KES 200,000 or to imprisonment for a term not exceeding 2 years or to both upon conviction.

    The VAT charged (output VAT) can be offset against VAT incurred in providing taxable supplies (input VAT). If you determine that you need to charge VAT on the supplies that you make to guests, please keep in mind that you have to collect this VAT from your guests and report and remit this VAT to the KRA by the 20th day of the following month. 

    • Reporting tax in Kenya

    Income tax (exceeding KES 40,000 in a year of income) for companies and individuals is paid in instalments via iTax . Instalment Tax is due on the 20th day of each quarter ending on the 4th, 6th, 9th and 12th month of the year of income.

    Any balance of tax (which is the difference between the total instalment tax paid in the year and the actual tax liability computed for the year after the year-end) for companies should be paid by 30 April of the subsequent year.

    Individual income tax (for individuals whose tax liability is below KES 40,000) is paid after filing the annual return online via iTax (which should be filed before end of June of the subsequent year as highlighted above).

    For all tax payments, a taxpayer (company or individual) is required to generate a payment slip and present it at any of the appointed KRA banks (all commercial banks in Kenya have a KRA bank account and can be used to pay the tax due).

    • Reporting tax payment deadline

    Late payment of tax is subject to 5% of the tax due and late payment interest of 1% per month on the unpaid tax until the tax is paid in full.
